One of the advantages of Next Best is that it can give advice to agents acting against duty. If you want to murder, you have to kill slowly, because although any murder is worse than no murder, soft murder is the best option (assuming your only options are brutal murder, gentle murder, and total abstention from murder). But Next Best, like Nothing Else Left, struggles with the consistent permissions of the All or Nothing problem. Next Best implies that if you don`t want to record two, you need to register One Save One. It seems too demanding. If there was only one person in the building, you wouldn`t have to sacrifice your legs to save them. This sacrifice would be supererogatory. So why should the same compromise be obligatory, provided that the two foreigners are not saved in the all-or-nothing problem? It should be conditionally optional. Our task in this article is to fill this gap by seeking a presentation of conditional judgments adapted to supererogatory and highlighting some difficult cases that such a presentation faces. Footnote 2 “PE(B)” means, of course, that B is fully eligible. If desired, we could define this as a permission dependent on a tautology: PE(B) = df PE(B/A or ¬A). First of all, unlike Nothing Else Left, our principle solves the problem of all or nothing. Remember your three options: Record zero (allowed), Save one (fake), and Record two (supererogatory). J&R conditional has the plausible implication that storing only one is allowed, provided both are not saved, as saving one is the best option compatible with not saving both. Also, saving zero is also allowed as long as both are not registered, as it is rightly worse than saving one (the only other option left). Conditional J&R succeeds where Nothing Else Left fails. Therefore, Baluran had to return the land to Obedencia.

We believe that the eligibility of an action – to what extent it is “preferred” – depends only on the degree of reason it requires. Now, some will say that even purely justifiable reasons are favorites. But if so, it is difficult to see how super-derogation could be favored over the moral minimum.
The justifying reason for keeping one`s kidney when it can outweigh the reason required to give will also greatly promote selfishness (Hurka & Shubert 2012, p. 9). Another objection to our view is that some reasons are purely laudable – they favor without justifying or demanding (Horgan & Timmons 2010; Archer, 2016; Little and Macamara 2017). But this seems to invite strange recombinations. Suppose we soften a bad action with glowing reasons until it`s the best option – even better than the allowed alternatives. Then the optimal option is wrong. This seems absurd. One of the virtues of our view is that it excludes such possibilities. Moreover, with Okay or Next Best we can solve the all-or-nothing problem.
