Fiji`s political commitment to the sustainable development and management of coastal and marine resources requires the vulnerability of coastal fisheries to overfishing and the impact of activities and development on land. Coastal communities are at the forefront of the impact of poor fisheries management and coastal and marine environmental degradation caused by land-based activities, and also play a central role in the management and management of coastal and marine resources. However, the Community`s governance and management capacities are hampered by the Community`s lack of knowledge of the laws governing coastal fishing and of its rights to authorise activities and development affecting coastal and marine areas. The Fiji Managed Marine Area Network (FLMMA) and the Women in Fisheries Network (WIFN), working closely with communities, have documented these impacts, ranging from overfishing by commercial and artisanal fishers to pollution of coastal waters from various sources, to oil pollution from oil tankers, molasses, molasses, mining and general waste, and excessive logging of mangroves. The use of mangroves as landfills and the effects of dredging. They also highlighted the need for increased community awareness of fisheries regulations and environmental management laws, both to ensure compliance with fisheries laws (e.g. improve the requirement for licences and permits) by small-scale fishers and enable the exercise of community rights with regard to environmental management and environmental impact assessment of land-based activities affecting coastal fisheries. Women and youth in the Community, as well as men, play an important role in the management of natural resources in the fisheries sector, but they often have limited access to capacity building and decision-making opportunities on these issues. Following an official visit to Fiji, the UN Special Rapporteur on human rights and the environment, David R. Boyd, said the island nation, through no fault of its own, was extremely vulnerable to the effects of climate change and associated natural disasters, and that rich countries should quickly increase their financial assistance. “When I received the scholarship, I knew right away that it was an opportunity to pursue my passions for sustainability in the Pacific and create opportunities to engage with both the sector and the region. When applied correctly, the law can be such a powerful tool in the world of environmental management and sustainable development. That`s why I decided to do an internship at FELA, a respected legal organization that leads political work on effective law enforcement, not only to protect the environment, but also to build the capacity of local communities to pursue sustainable goals.

“Investment Fiji`s one-stop online authorization system allows companies to register online, apply for a FIRC and pay the registration fee. Information on registration procedures, regulations and registration requirements for foreign investments can be found on the Fiji investment website: www.investmentfiji.org.fj. However, the most recent reporting requirements may not be available on the site. The Government of Fiji`s bizFiji (www.business-fiji.com) website, an information portal for new and existing businesses and foreign investors, contains links to the Investment Fiji website. Since the launch of bizFiji in 2019, the government has been working to develop a unified online clearing system to improve registration processes, but inefficiencies remain. FELA organized a 3-day fishing forum at the Tanoa Plaza Hotel in Suva. The objective of the Forum is to facilitate legal discussion among relevant stakeholders on existing legal instruments and mechanisms that can contribute to effective fisheries management, to identify gaps/gaps and challenges and to seek practical legal solutions to fill these gaps. On Day 1 of the Legal Forum, a wide range of topics were discussed, which led to a lively exchange between participants and moderators. #FELA2016 #CoastalFisheriesManagement #LegalDevelopmentForum The Constitution contains other new provisions to protect land leases and land leases, but observers have noted that these provisions have unintended consequences, including weakening the general legal structure of leases. The law provides criminal penalties for corruption by officials, but the government does not enforce the law effectively. The government has established the Fiji Independent Anti-Corruption Commission (FICAC), which has extensive investigative powers. FICAC`s public announcements encouraging citizens to report corrupt government activities have had some impact on systemic corruption.

The government adequately funded FICAC, but some observers questioned its independence and considered some of its high-profile prosecutions to be politically motivated. Media outlets publish articles about FICAC investigations into abuses of power, and anonymous blogs report on government corruption. However, Fiji`s relatively small population and limited circles of power often mean that personal relationships play an important role in business and government decisions. Fiji acceded to the United Nations Convention against Corruption (UNCAC) in 2008. For general information on the political and economic environment of the country, please click on the link to the United States. State Department website Countries and Regions. This Legal Bulletin reviews the general international legal framework for the protection and conservation of the marine environment set out in the 1982 United Nations Convention on the Law of the Sea and suggests measures other than Pacific Island Committees, regional organizations and civil society organizations, in accordance with the Standing Committee on the Environment, can take to combat marine pollution in the Pacific Ocean. The Foreign Investment Act (AIF) and the Foreign Investment Regulations 2009 regulate foreign investment in Fiji. All companies with a foreign investment component in their possession must register and obtain a Foreign Investment Registration Certificate (FIRC). Information on registration procedures, regulations and registration requirements for foreign investments can be found on investment Fiji`s website: www.investmentfiji.org.fj.

The changes to the FIA also require foreign investors to seek approval before making changes to the company`s ownership structure, with penalties for non-compliance. Although Fiji has traditionally had a strong judicial system in which contractual rights are generally respected, the lack of independence of the judiciary and the length of judicial process raise due process concerns. In addition to TLTB and Department of Lands requirements, urban planning, conservation and other requirements set by central and local government agencies affect land use. Investors are encouraged to seek local legal advice on all real estate transactions. Companies and individuals can resort to legal treatment through the system of local and higher courts. A foreign investor theoretically has the right to appeal to Fijian courts regarding dispute settlement, but government laws have been used to prevent foreign investors from resorting to investment takeovers, tax increases or government interest write-downs. Responsible Business Conduct (RBC) is increasingly encouraged, and the government has included legal provisions to protect the environment, consumers, human rights and labour rights, although RBC`s oversight and enforcement is mixed.
