Cockfighting has been a sport in the United States since at least the early 1800s and was a favorite sport of settlers. By 1860, only three states had banned the sport, but today 48 states and the District of Columbia have banned cockfighting, with cockfighting only legal in Louisiana and parts of New Mexico. Overcrowding conditions mean that chickens cannot perform most of their normal behaviors. They cannot walk, fly, sit, bask, nest, peck, bathe in dust or scratch for food. Chickens may not even be able to get up, and their feet can actually grow into the metal bottom of their cages. Although the Animal Welfare Act (AWA) explicitly excludes rats, mice, birds, and farm animals from its protection, the National Institute of Health (NIH) requires all research institutions conducting research funded in whole or in part by the NIH to care for their laboratory animals in accordance with the guidelines in its book The Guide for the Care and Use of Laboratory Animals (the “Guide”).
