I have always believed that a question of process should be an ideal that we have as a society. It`s an ideal that no one can really argue with as right. The goal is to make the subject simple, understandable and undeniable. The theme will be your mantra throughout the process, from voir dire, opening statement, direct cross-examination and cross-examination to closing arguments. Usually, there is a general theme for the case. However, this does not mean that there are not other sub-themes that also apply to certain aspects of the case. It is important to select the subjects well in advance of the testing phase in order to organize your thoughts and preparations. The cooperation promises to extend far beyond the borders of a law firm. It is cloud-powered and includes customers, partners, and legal service providers, including real-time reporting, business initiation, and the status of third-party vendor payments.
I know that many litigators use focus groups for their pre-trial cases, which is a great way to test your litigation topics. In some cases, several focus groups are useful to compare how different topics resonate with potential judges. Certainly, focus groups are a great way to find the right topic for your case. One of the things I`ve noticed in recent years is that juries are generally more receptive to the concept of punitive damages. I have found that this is also true in conservative jurisdictions. I think the reason is that most jurors have heard of corruption cases where people have defrauded other people with money. I bring examples like Bernie Madoff, Charles Keating, Jeffry Skilling and Enron to make judges think. Examples like these evoke the idea that greed sometimes causes people and/or companies to do bad things while harming others. In the end, you unite the jury to agree that if the behavior was dishonest, it should be punished.
If you`ve been in the legal community long enough, you tend to see the same issues over and over again. This is our observation when we think back to the last decade and look around the corner. In fact, we see so many recurring themes that we can`t incorporate them all at once. Wow – thanks! I`ve always struggled to construct case themes, and I`ve never been able to come up with a good plan for their development. I tore up some of the common themes that other litigators used, but I always wanted to create my own unique themes for the trial. I think this will be a good starting point for me – I`ve bookmarked this link so I can refer to it whenever I take on a new client`s case. Thanks again! The cloud has been around for a long time, but it has evolved in the legal industry with foreclosures. It started as an ethical issue that many state bar associations took a long time to publish an opinion. When these opinions finally began, the gist came down to Yes, it`s ethical, but lawyers still have to fulfill their duty of care regarding security, storage, jurisdiction, and other important responsibilities prescribed in documents such as the Model Rules of Professional Conduct.
New legal business titles among allied professionals in pricing, strategy and security are perfect examples. All of this was rare, if ever, around 2008. At that point, the Great Recession caused businesses to question all of their spending, including legal services, triggering arguably the greatest disruption the legal industry has ever seen. “Mobility has become part of our culture as the skills associated with it have shaped the expectations of law firms. Lawyers and employees want the productivity that comes with mobility, while clients demand efficiency. Most importantly, the legal transaction will benefit from both. It certainly doesn`t take an employee to drive an hour to the office on a Saturday to turn a watch face, pull a lever, or press an approval button for a legal business process. “Determining the right topics for your study is important for many reasons. It brings clarity and simplicity to the presentation of the file. In the end, this convinces a jury. I hope this article helps you use your trial topics effectively in your next jury trial. We have been carrying powerful little computers in our pockets for so long; The potential for mobility is sometimes taken for granted.
Mobile access to legal IT systems is convenient, but also productive and efficient. I always try to find a unique theme for the particular case I`m going to try. Sometimes I can do it, but that`s not always the case. I often fall back on proven test subjects that many have used in the past. For example, here are some examples of common themes: So who is responsible for innovation leadership in law firms? Most likely, this person is not a lawyer, but an allied lawyer. A landmark study commissioned by the California State Bar supports this idea: the key to “productivity requires lawyers to work closely with professionals from other disciplines.” The study highlights the many changes coming to the legal industry that will almost certainly impact the future of innovation in legal affairs. Here are five of the themes that seem to recur in the legal community and legal technology: Unfortunately, many litigators never create strong themes for their cases. They know how to use themes, but they have no idea how to develop them or where to start looking for ideas, and so they never use them. In this article, you`ll find a great resource for developing case topics.
Depending on the topic chosen by the jury, it will look for evidence to support this view. That`s why it`s so important to invest time in developing your topics. The better your topic “captivates” the judges, the more chances you have of winning. Personally, I don`t do a lot of focus groups. But those who know me know that I talk about my cases all the time. I tell everyone about my upcoming exams: my family, the gas station attendant, the waitress at a restaurant, my friends, the trainer at the gym, and I could go on and on. I especially like to test my subjects with my most conservative and skeptical friends, because that`s more the kind of judge I`m going to have in the trial. Whatever your approach, take the topics you have on paper and test them with people. The feedback you receive will be very helpful as you fine-tune your preparation for the trial version. In this article you will find dozens of different slogans of movie posters and promotional items.
Read them (or, better yet, read them aloud) while you think about your case. They`re not ranked in any particular order, and they`re not necessarily the best (or worst) films ever made, but they`re a great starting point for writing your own subjects.
