ISDA has issued a number of legal opinions related to set-off to assist ISDA members in applying the risk weights set out in section 305 of the RRC.
One of the conditions for the application of the reduced risk weights provided for in Article 305 is that the client of a clearing member has the legal opinion that it would not suffer “losses” as a result of the insolvency of its clearing member or a client of the clearing member under the jurisdiction of different affiliated entities.
