Sudden separation, lack of news, insecurity and fear of reprisals make it impossible to grieve for a loss and cause indelible suffering. The Enforcement Convention depends on States parties implementing laws to criminalize enforced disappearances, investigate potential cases and hold individuals to account. The Committee on Enforced Disappearances, mandated under the Convention on Enforced Disappearances to monitor compliance by States parties, itself has very limited enforcement powers. When a complaint is made against a State Party, the Committee may request information from that Party and visit the State, but it can only make recommendations and require the State to take all necessary measures to resolve the situation. It cannot force the state to act and does not have the power to impose sanctions. Furthermore, the Committee has no jurisdiction over States that are not parties to the Convention. Nor is there a mechanism for a single injured person — a missing person or his or her family — to seek redress under the Convention on Enforced Disappearances. The United Nations Human Rights Monitoring Mission in Ukraine (HRMMU) has documented at least 230 cases of enforced disappearances and detentions in the first 100 days of the current conflict.
